A)  About OOWI

 

1) OOWI

OOWI is a French company that offers mobility solutions around the Electrically Assisted Bicycle.

 

2) What is the link between the municipality and you?

OOWI is the operator of the service. An agreement is signed with the municipality with an authorization to use the public domain.

 

3) Where can I find an OOWI bike

The OOWI Application allows you to view the nearest stations.

When the station is orange, bikes are available (just click on the station to see the number of bikes available). When the station is grey, there are no bikes available.

 

4) Are batteries mandatory?

No, you can use the bikes in mechanical (without battery) or electric mode. The subscription is different but the conditions of use remain the same.

 

 

B) Use of the Bike

 

1) How do I unlock my bike?

To unlock your bike, simply connect to the OOWI application, register (only the first time), scan the QR code of the bike or the lock and the latter will unlock automatically.

 

2) Is a minimum age required to use OOWI bikes?

For legal and insurance reasons, you must be 16 or older to ride an OOWI bike.

 

3) Where should I park my bike to finish my journey?

To stop your rental, you must park your bike at an OOWI station. Outside the zones, you will be charged €0.05/minute.

 

4) How do I lock my bike?

Simply close the lock and pass the cable around the station support. To finish your run, the app will ask you to take a picture of the bike. An audible signal will let you know that your bike is securely locked. Do not forget to take your battery back if you have one.

 

5) Is it possible to take a break during my run?

Yes, during your run, you can pause your bike by locking it (lock + cable). Your race is not over, no other user can unlock your bike.

 

6) Is it possible to reserve a bicycle?

No, it is not possible to reserve a bicycle.

 

 

 

C) Rates and means of payment

 

1) Do I have to be a subscriber to use my bike?

No, you can take a bike without a subscription, on request. However, you must be registered for the service.

 

2) What is the cost of a trip?

If you are a subscriber, the first 30 minutes are free, then €0.05 per minute.

If you are not a subscriber, the price is €1 when you get started, then €0.05 per minute (i.e. €3 per hour).

 

3) How to change credit card?

In the OOWI application, in your account, "Manage payment methods".

 

4) How do I cancel my subscription?

In the OOWI application, in your account, "Manage (or choose) my formula".

 

5) Can I have an invoice?

Yes you can get an invoice with the OOWI application.

 

 

E) Urgencynces

 

1) What should I do if I have an accident with an OOWI bike?

If the accident is serious, call the emergency services directly. Otherwise, contact us via the application (“contact” section).

 

2) What are the emergency numbers?

Do not forget the emergency numbers: 112 is the emergency number valid throughout the European Union).

3) How can we contact you directly?

F) Insurance

 

1) Is there insurance in the event of an accident?

You are covered by your civil liability.

 

2) Is there insurance in case of theft of the bike or my battery?

No, in the event of theft, an excess of €300 for the bike and €80 for the battery will be payable by you.

 

 

G) Security

 

1) Is the helmet mandatory?

It is not mandatory but we strongly recommend it.

 

2) What is the authorized speed?

The user is required to respect the highway code.

 

3) Can I ride in bad weather?

Yes, our bikes are designed to be used in all circumstances. Be sure to take the necessary precautions in case of bad weather by riding slowly and being even more careful than usual.

H) Traffic areas

 

1) How do I know where traffic areas are limited?

With OOWI, there are no demarcated areas. You just have to park the bike in an OOWI zone to end your rental.

 

I)  I have a problem

 

1) In the event of a problem with a bicycle, who should I contact?

Report directly in the application by clicking on the triangle icon () at the top right "Report a problem". We will contact you afterwards. In any case, the bike you have unlocked must be returned to an OOWI station to complete the rental.

 

2) For any other problem, who should I contact?

In case of emergency, you can contact: 112 is the emergency number valid throughout the European Union).

3) What should I do if my bike is stolen during my race?

You are responsible for your vehicle from the time you unlock it until you lock it in an OOWI zone. In the meantime, if your bike is stolen, report directly in the application by clicking on the triangle icon () at the top right "My bike has been stolen". We will contact you afterwards.

 

4) I had a billing problem, how do I get a refund?

5) If I see an abandoned bicycle, who should I contact?

6) What should I do if I forget to lock my bike?

As soon as you realize it, go directly to see if it is still there where you put it. If not, contact us directly.

We regularly review our Privacy Policy and, therefore, we encourage you to periodically review this web page or through the application. It is important that the personal data about you that we hold is accurate and up to date. 2. WHAT PERSONAL DATA ARE WE LIKELY TO COLLECT?

The term "Personal Data" means any information relating to an identified or identifiable natural person who can be identified, directly or indirectly, in particular by reference to an identifier, such as a name, an identification number, location data , an online identifier, etc.

We may collect, use, store and transfer different types of personal data about you (i.e. any information allowing you to be directly or indirectly identified) grouped together as follows:

  • Data related to your identity and contact details: this includes your first name, last name, username, password, email address, telephone numbers and other similar identifiers.

  • Financial and transactional data: this includes certain information relating to your bank account and payment card as well as any information relating to the payments you have made and any other details relating to the services you have purchased from us and other similar details. Please note that we do not store your full payment card information. This information is stored by our approved third-party payment partner.

  • Technical and usage data: this includes information about how you use our App and our Bikes (including your ride and location history), the type and version of the operating system of the phone used.

  • Profile Data: This includes the services and subscriptions you have selected.

In the event that we need to collect your personal data under our Terms and Conditions and you do not provide us with the data requested, we may not be able to perform the contract we have entered into. or try to conclude with you. In which case, it is also possible that we cannot authorize you to use the Application.

 

3. HOW AND WHY DO WE COLLECT THIS DATA?

By creating an account in the Application, you provide the information requested and as a User you consent to the collection and processing of your Personal Data by the Company or any designated service provider, in accordance with all applicable regulations. protection of personal data, in particular the provisions of the General Data Protection Regulation n ° 2016/679 of April 27, 2016 (RGPD), of the law “Informatique et Libertés” n ° 78-17 of January 6, 1978 modified in particular by law n° 2018-493 of June 20, 2018, as well as the law "for confidence in the digital economy" n° 2004-575 of June 21, 2004.

The Company is responsible for processing the Personal Data collected as part of the Services.  In any case, the Company undertakes to comply with the laws and regulations in force relating to the protection of private life.

The Personal Data collected by the Company is strictly necessary for the management and execution of the Services (invoicing, payment, access to the Bikes, customer service, journeys, etc.). These personal data (telephone number, surname, first name, email and bank details) as well as the application are transmitted to the payment platform STRIPE. »

You have the choice of being able to trace your journeys with the application or not: the request is made explicitly in a dedicated window. If you choose "yes" to this request, the application traces the location in the background in order to give you access to the tracking and statistics of the trip. If you choose "no", location is not activated in the background. This feature is only used while driving.

In this context, as a User you accept that certain information collected about you may be processed in a country outside the European Union, the Company endeavoring to take appropriate measures to maintain an optimal level of confidentiality and security of your Personal Data, in particular by requiring all its subcontractors and service providers to implement all appropriate technical and organizational measures, on an ongoing basis, to secure this Personal Data to ensure the same level of protection as that required by French and Community regulations on Personal Data.

You agree that your Personal Data will be stored, processed and transferred by the Company to its subcontractors or service providers for the aforementioned needs, who will only be able to access it in compliance with the legal and regulatory provisions in force.

The Personal Data collected also allows the Company to send you promotional offers or to inform you of new services.

 

4. HOW LONG WILL WE USE YOUR PERSONAL DATA? 

We will retain your personal data only for as long as reasonably necessary to fulfill the purposes for which we collected it, including for the purposes of complying with any legal, regulatory, tax, accounting or reporting requirements. We may retain your personal data for longer in the event of a complaint or if we reasonably believe that a dispute is likely to arise in connection with our relationship with you. To determine the appropriate retention period for personal data, we take into account the amount, nature and degree of sensitivity of the data in question, the risk of harm in the event of unauthorized use or disclosure of your data personal data, the purposes for which we process your personal data, whether we can fulfill those purposes by other means, and applicable legal, regulatory, tax, accounting and other requirements.

In certain situations, we will irreversibly anonymize your personal data (so that it can no longer identify you) for research purposes as well as for statistical purposes, in which case this policy will no longer apply. and we may use such data for an indefinite period without further notice.

Please note that we are legally required to retain basic information about our customers for seven years after they cease to be customers for tax purposes.

 

5. DATA SECURITY

We have implemented appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorized manner, altered or disclosed. In addition, we limit access to your personal data to our employees, representatives, contractors and other third parties who need to know it for the purposes of performing their functions. The latter will only process your personal data on our instructions and are subject to an obligation of confidentiality. We have put in place procedures to deal with any suspected personal data breach, and we will notify you and any relevant regulator of the breach if we are legally required to do so.

 

6. WHAT ARE YOUR LEGAL RIGHTS?

B2eBike undertakes to respect the legal rights that its customers have in terms of data protection. If you send us a request regarding your rights under data protection law, we will respond to you within one month of the date of receipt and attempt to comply with the request within the same period. If necessary, this period may be extended by a maximum of two months if the request is complex.

In accordance with the law "Informatique et Libertés" of January 6, 1978, in its last modified version in force, and the General Regulations on Data Protection, as a User you have the right to access, rectify, erasure, opposition and portability of Personal Data concerning you, as well as a right to limit the processing that the Company operates in relation to this Personal Data, you can exercise the rights:
